General
1.1 These general terms and conditions apply to all offers from ABC-Led.nl. The terms and conditions are accessible to everyone and are included on www.ABC-Led.nl. We will send you a written copy upon request.
1.2 By placing an order, you agree to the terms of delivery and payment. ABC-Led.nl reserves the right to change its terms of delivery and/or payment after the expiration of the term.
1.3 Unless otherwise agreed in writing, the general/specific terms or conditions of third parties are not recognized by ABC-Led.nl.
1.4 ABC-Led.nl guarantees that the delivered products correspond to the agreement and meet the specifications stated in the offer.
2. Delivery
2.1 Delivery will take place while stocks last.
2.2 ABC-Led.nl will process all orders as quickly as possible within the specified delivery time. If this is not possible, the customer will be notified within a few business days of placing the order, and in that case, they have the right to cancel the order without charge and without notice of default. Reasons for this are: The ordered products are out of stock or no longer available; There is a delay in delivering the ordered products for other reasons; An order cannot be processed or can only be processed partially.
2.3 ABC-Led.nl's delivery obligation will be fulfilled, unless proven otherwise, once the goods delivered by ABC-Led.nl have been offered to the customer once. In the case of home delivery, the carrier's report, including the refusal of acceptance, serves as full proof of the offer of delivery.
2.4 All delivery times are indicative. Consumers cannot derive any rights from any stated delivery times. Exceeding a delivery time does not entitle the consumer to compensation.
3. Prices
3.1 Prices will not be increased during the duration of the offer, unless legal measures make this necessary (for example, a change in the VAT rate).
3.2 All prices on the website are subject to printing and typographical errors. We accept no liability for the consequences of printing and typographical errors.
3.3 All prices on the site are in euros and include 21% VAT.

5. Inspection period / right of withdrawal
5.1 The consumer can cancel an agreement regarding the purchase of a product within a cooling-off period of at least 14 days without giving any reason. This cooling-off period begins on the day after the consumer receives the product.
5.2 The buyer will unpack or use the product to the extent necessary to determine whether they wish to keep it. Returns should be made, if reasonably possible, in their original packaging and in their original condition.
5.3 The buyer is obligated to notify the buyer of their intention to cancel the purchase within 14 days of receiving the product. This must be done via the return form available at www.ABC-Led.nl. After completing this return form, the buyer will receive all return instructions by email.
5.4 After the consumer has indicated that he/she wishes to exercise his/her right of withdrawal, he/she must return the product within 14 days and prove that the delivered goods have been returned on time (for example by means of proof of postal delivery).
If the customer has not indicated that he or she wishes to exercise his or her right of withdrawal or has not returned the products after the above periods have expired, the purchase is final.
5.5 If the entire order is cancelled, the customer will also be reimbursed for the shipping costs paid for the order. If the customer opted for a more expensive delivery method than the cheapest standard delivery, the additional costs for the more expensive method will not be refunded.
5.6 The costs of return are for the account of the buyer, unless otherwise agreed.
5.7 The amount will be refunded as soon as possible, but no later than 14 days after cancellation. This is subject to the condition that the product has already been received or conclusive proof of complete return can be provided.
5.8 Exclusion of the right of withdrawal applies to products that have been made according to the consumer's specifications.
5.9 Refunds will be made using the same payment method the customer used. This will only be different if the customer authorizes a different payment method. In that case, we will not charge any additional fees.
5.10 The purchaser is only liable for any diminished value resulting from the use of the product that goes beyond what is necessary to assess the nature, characteristics and functioning of the product.
6. Complaints
5.1 Complaints submitted will be answered within 14 days of receipt. If a complaint requires a longer processing time, the consumer will receive a response within 14 days with an acknowledgement of receipt and an indication of when a more detailed response can be expected.
7. Data management
7.1 If you place an order with ABC-Led.nl, your details will be included in the ABC-Led.nl customer database. ABC-Led.nl complies with the Personal Data Protection Act and will not provide your details to third parties.
7.2 ABC-Led.nl respects the privacy of users of its website and ensures that your personal data is treated confidentially.
7.3 ABC-Led.nl uses a mailing list (upon registration). Each mailing includes instructions for removing yourself from this list.
8. Warranty
8.1 ABC-Led.nl guarantees that the products it supplies meet the requirements of usability, reliability, and lifespan as reasonably intended by the parties to the purchase agreement, and therefore guarantees the manufacturer's warranty for the product supplied to you.
8.2 The ABC-Led.nl warranty period corresponds to the manufacturer's warranty period. However, ABC-Led.nl is never responsible for the ultimate suitability of the products for each individual application by the purchaser, nor for any advice regarding the use or application of the products. ABC-Led.nl is not liable for any damage caused by delivered products. Use and application of the delivered products and goods are always at the purchaser's risk.
8.3 The buyer is obligated to inspect the delivered goods immediately upon receipt. If the delivered item appears to be incorrect, defective, or incomplete, the buyer must (before returning it to ABC-Led.nl) immediately report these defects via the contact form at www.ABC-Led.nl. Any defects or incorrectly delivered goods must and can be reported to ABC-Led.nl in writing no later than 14 days after delivery. The goods must be returned in the original packaging (including accessories and any accompanying documentation) and in new condition.
8.4 If ABC-Led.nl finds the customer's complaints to be justified, ABC-Led.nl will, at its discretion, either replace the delivered goods free of charge or make a written arrangement with the customer regarding compensation, provided that ABC-Led.nl's liability, and therefore the amount of compensation, is always limited to the invoice amount of the goods in question, or (at ABC-Led.nl's discretion) to the maximum amount covered by ABC-Led.nl's liability insurance in the relevant case. Any liability of ABC-Led.nl for any other form of damage is excluded, including additional compensation in any form whatsoever, compensation for indirect or consequential damage, or damage due to lost profits. If you are not satisfied with the handling of your complaint, you can submit it to the European Commission's ODR (Online Dispute Resolution) platform.
8.5 ABC-Led.nl is not liable for damage caused intentionally.
8.6 This warranty does not apply if: A) and for as long as the buyer is in default towards ABC-Led.nl; B) the buyer has repaired and/or modified the delivered goods themselves or has had them repaired and/or modified by third parties. C) the delivered goods have been exposed to abnormal conditions, are otherwise handled carelessly, or have been handled contrary to the instructions of ABC-Led.nl and/or the instructions for use on the packaging; D) the defect is wholly or partly the result of regulations that the government has imposed or will impose regarding the nature or quality of the materials used;
9. Offers
9.1 Offers are without obligation, unless otherwise stated in the offer.
9.2 During the validity period stated in the offer, the prices of the products and/or services offered will not be increased, except for price changes due to changes in VAT rates.
9.3 Verbal commitments only bind ABC-Led.nl after they have been expressly confirmed in writing.
9.4 Offers from ABC-Led.nl do not automatically apply to repeat orders.
9.5 ABC-Led.nl cannot be held to its offer if the buyer should have understood that the offer, or a part thereof, contained an obvious error or typo.
9.6 Additions, amendments and/or further agreements are only valid if agreed in writing.
10. Agreement
10.1 An agreement between ABC-Led.nl and a customer is concluded after an order has been assessed for feasibility by ABC-Led.nl.
10.2 ABC-Led.nl reserves the right to refuse orders or assignments without stating reasons.
11. Images and specifications
11.1 All images, photos, drawings, etc., including data regarding weights, dimensions, colors, images of labels, etc., on the ABC-Led.nl website are approximate only, are indicative, and cannot give rise to compensation or termination of the agreement.
12. Force Majeure
12.1 ABC-Led.nl shall not be liable if and to the extent that its obligations cannot be fulfilled due to force majeure.
12.2 Force majeure means any external cause, as well as any circumstance that cannot reasonably be considered our risk. Delays or non-performance by our suppliers, internet disruptions, power outages, email disruptions, and disruptions or changes to technology supplied by third parties, transportation difficulties, strikes, government measures, supply delays, negligence by suppliers and/or manufacturers of ABC-Led.nl and their assistants, illness of personnel, and defects in auxiliary equipment or means of transport are expressly considered force majeure.
12.3 In the event of force majeure, ABC-Led.nl reserves the right to suspend its obligations and is also entitled to terminate the agreement in whole or in part, or to demand that the content of the agreement be amended in such a way that performance remains possible. Under no circumstances is ABC-Led.nl obligated to pay any fines or damages.
12.4 If ABC-Led.nl has already partially fulfilled its obligations upon the occurrence of force majeure, or can only partially fulfill its obligations, it is entitled to invoice separately for the part already delivered or the part that can be delivered, and the buyer is obligated to pay this invoice as if it were a separate contract. This does not apply, however, if the part already delivered or the part that can be delivered has no independent value.
13. Liability
13.1 ABC-Led.nl is not liable for damage to vehicles or other objects resulting from the use of delivered goods. Always read the instructions on the packaging before use and/or consult our website.
14. Retention of title
14.1 Ownership of all goods sold and delivered by ABC-Led.nl to the purchaser shall remain with ABC-Led.nl as long as the purchaser has not paid the claims of ABC-Led.nl under the agreement or previous or subsequent similar agreements, as long as the purchaser has not paid for the work performed or yet to be performed under this or similar agreements and as long as the purchaser has not paid the claims of ABC-Led.nl due to failure to fulfill such obligations, including claims relating to fines, interest and costs, all as referred to in Article 3:92 of the Dutch Civil Code.
14.2 Items delivered by ABC-Led.nl that are subject to retention of title may only be resold in the course of normal business operations and may never be used as a means of payment.
14.3 The purchaser is not authorised to pledge or otherwise encumber the items subject to the retention of title.
14.4 The purchaser hereby gives unconditional and irrevocable permission to ABC-Led.nl or a third party to be appointed by ABC-Led.nl to enter all places where its property is located and to take those items with it in all cases in which ABC-Led.nl wishes to exercise its ownership rights.
14.5 If third parties seize the goods delivered under retention of title or wish to establish or assert rights thereto, the purchaser is obliged to inform ABC-Led.nl as soon as can reasonably be expected.
14.6 The buyer undertakes to insure and keep insured the goods delivered under retention of title against fire, explosion and water damage as well as against theft and to make the policy of this insurance available for inspection to ABC-Led.nl upon first request.
